MEMBERSHIP AGREEMENT
1.PARTIES
1.1.This membership agreement ("Membership Agreement") has been prepared between https://www.foxsestore.com ("Fox’s eStore") and Member ("Member") to determine the conditions for the Member to benefit from the Services offered by Fox’s eStore on the website.
1.2. Fox’s eStore and Member will be referred to as "Party" and "parties" in this Membership Agreement individually.
2.DEFINITIONS
2.1. The "Cookie Policy" refers to the text that contains information about cookies used to improve members’ shopping experience and to provide content that is appropriate to their preferences and tastes in line with information about members’ visits to the website.The text is accessed by our website at https://www.foxsestore.com/cookie-policy.
2.2. The "Privacy Policy" refers to the text that contains information about how members' personal data is protected, such as for what purpose and how to use it by Fox’s eStore. The text is accessed by our website at https://www.foxsestore.com/privacy-policy.
2.3. The "Account" Page refers to the specific page for the member, which can only be accessed by the user name and password set by the member, including personal data required to use the Application and Services, and the member-requested information.
2.4. The ‘’Service’’ refers to the services and applications provided by Fox’s eStore or Fox’s eStore’s designated partner to enable members and visitors to perform the work and operations defined within this Membership Agreement.
2.5 The "Virtual Store" refers to the virtual area on Fox’s eStore where the content and images are published for the sale of products and/or services on the website.
2.6 The “Member” refers to the real person who purchased the products and/or services offered on the website under this Membership Agreement with Fox’s eStore.
2.7. The “Website Ownership” refers to the website, mobile apps and mobile site that belongs to Fox’s eStore and has www.foxsestore.com domain names that Fox’s eStore is offering.
2.8. The "Visitor" Refers to the real person who uses the website without membership and takes advantage of the Services.
3. SCOPE AND PURPOSE OF THE MEMBERSHIP AGREEMENT
3.1. Fox’s eStore is the intermediary service provider who runs this website and sells products.
3.2. Under the Membership Agreement, the Member intends to subscribe to the website, benefit from the Services and purchase the products and/or services sold on this platform.
3.3. The purpose of the Membership Agreement is to determine the terms and conditions for the benefit of the Services and the rights and responsibilities of the parties.
3.4. By the Member's acceptance of the Membership Agreement, the Member acknowledges and agrees to any statements regarding the Services, use, content, applications and members contained on the website.
3.5. In order to avoid suspicion, the Membership Agreement is only among the parties and covers the terms and conditions of the Services contained on the website.
4. THE RIGHTS AND OBLIGATIONS OF THE PARTIES
4.1. To obtain membership status, the Membership Agreement must be approved and fill in the information requested on the membership page with accurate and up-to-date information. The user who wants to become a member must be over 18 (eighteen) years old. The Member, who does not provide accurate and up-to-date information when completing the Membership Agreement, is responsible for any damages that may arise.
4.2. In the event of a dispute over the ownership of an account between certain people,Fox's eStore has the right to take an action and to decide who the owner of the account is.
4.3. Member acknowledges and declares that the Member shall act in accordance with the provisions of this Membership Agreement, all the conditions set forth on the website, the applicable legislation and the code of ethics. The legal and criminal responsibility for the actions and actions taken by the Member on the website is his own.
4.4. Fox’s eStore will be able to share the Member's information with the authorities at the request of the competent authorities, if necessary, by providing the Member's information in advance and subject to data transfer rules in all cases.
4.5. The user name and password information that the Member needs to access the My Account Page and perform transactions through the website is generated by the Member and the security and confidentiality of such information is entirely the Member's responsibility.
4.6. The Member acknowledges, declares, and undertakes that the actions carried out by the user name and password of his own, and that his responsibility for these transactions is his own, and that he will be deemed to have carried out the work and actions carried out in this manner, and that he cannot object.
4.7. Member shall not use the website in an unlawful and immoral manner, particularly in the following cases:
4.7.1. Use of the website for the purpose of creating databases, records, or guides on behalf of any person;
4.7.2. Use of the entire or part of the website for degradation, replacement or reverse engineering;
4.7.3. Using incorrect information or other person's information, incorrect or misleading residence address, e-mail address, communication, payment or account information, creating non-genuine Membership accounts using false or misleading personal data, and using these accounts in violation of the Membership Agreement or laws, Unauthorized use of another Member's account, substituting another person or being involved in transactions under the wrong name;
4.7.4. The interpretation and scoring systems; Use of comments on the website for non-website purposes, such as posting them outside the website, or to manipulate systems;
4.7.5. Spread any other harmful technology or virus to the website, website's database, any content contained on the website;
4.7.6. Collection or use of any information about members, including their email addresses, without the permission of the relevant persons;
4.7.7. The Member is obliged to conduct his/her actions on the website in a manner that does not technically harm the website. The Member also agrees not to enter the Account Page with a robot or automatic input methods.
5. TERMINATION OF CONTRACT
5.1. Any of the parties may terminate this Membership Agreement unilaterally and at all times without compensation. In the event of such termination, the parties shall fulfill the rights and debts that have been born until the date of termination.
5.2. Fox’s eStore reserves the right to suspend, terminate, and court the membership if the Member detects or has reasonable doubt that it has violated any provision of this Membership Agreement.
6. PROTECTION OF PRIVACY AND PERSONAL DATA
6.1. Fox’s eStore values the processing, security and protection of the Member’s personal data provided through the website in accordance with the laws. Fox’s eStore collects, uses, transfers and processes the personal data provided by the Member in accordance with the "Privacy Policy" and "Cookie Policy" on the website. A Member can always review the Privacy Policy on the website to learn more about the terms and rights associated with the use of his personal data.
6.2. Personal data shared by the Member to create a Membership on the website or to benefit from the website; Performance of the obligations set out by the Membership Agreement, execution of the applications required for the operation of the website, providing various benefits to Member or Visitor, performing payment transactions, making order deliveries, performing customer service and complaint monitoring, and any electronic communication, profiling, similar purpose, specific advertising, sales, marketing, questionnaire, etc. It is collected, stored and processed by Fox’s eStore or its partners in accordance with the Privacy and Personal Data Protection Policy and the Cookie Policy for statistical studies.
7. INTELLECTUAL PROPERTY RIGHT
7.1. The www.foxsestore.com brand and logo, and the website's design, software, domain name, and any other intellectual property rights created by Fox’s eStore, including any brand, design, logo, trade dress, slogan and other content are the property of Fox’s eStore.
7.2. The member cannot use, share, distribute, display, reproduce, or derivate intellectual property rights subject to the ownership of Fox’s eStore or its affiliates without the permission of Fox’s eStore.
7.3. The Member cannot use the entire or part of the www.foxsestore.com website without the permission of Fox’s eStore in another environment.
7.4. If the Member acts in a manner that violates the intellectual property rights of third parties or Fox’s eStore, the Member is obliged to reimburse all direct and indirect damages and expenses of Fox’s eStore and/or the third party in question.
8. CHANGE IN CONTRACT RULES
8.1. Fox’s eStore may, at its sole discretion, modify this Membership Agreement and any policy, including the Privacy Policy and Cookie Policy contained on the website at any time, by declaring it on the website, without violating the applicable legislation provisions, unilaterally.
8.2. The changing terms of this Membership Agreement will be effective on the date they are announced on the website, and the remaining terms will remain in force and the terms and consequences will continue to be applied.
8.3. In order to avoid suspicion, this Membership Agreement may not be amended unilaterally by the Member.
9. UNEXPECTED SITUATIONS
9.1. If unexpected or extraordinary cricumstances arise and Fox’s eStore delays its services from fulfilling its obligations arising from this Membership Agreement for the reasons stated below, Fox’s eStore cannot be held liable for its obligations that are blocked or delayed, and this is not considered a breach of this Membership Agreement;
9.2. Riot, embargo, government intervention, rebellion, occupation, war, mobilization, strike, location, business actions or boycotts, worker-employer disputes, cyber-attack, communication issues, infrastructure and internet failures, system improvements or restoration efforts and consequently failures, power failure, fire, explosion, storm, flood, earthquakes, migrations, epidemics or other natural disasters and other unreasonably unpredictable events etc.
10. OTHER PROVISIONS
10.1. When dispute arises from this Membership Agreement, the Member acknowledges that electronic information, electronic correspondence, computer records and this agreement in Fox’s eStore database records will constitute evidence.
10.2. Fox’s eStore will communicate with the Member via the electronic mail address that the Member reported when registering or by making calls and sending messages to the phone number via whatsapp. The member is obliged to keep the email address and phone number up to date.
10.3. This Membership Agreement constitutes the entire agreement between the parties. If any provision of this Membership Agreement is determined by any competent court, or administrative office to be completely or partially invalid or not applicable, the Membership Agreement may be split and will remain in effect in other provisions.
10.4. Transfer of Membership Agreement. The Member may not assign, in whole or in part, its rights or obligations under this Membership Agreement without the prior written consent of Fox's eStore.
This Membership Agreement, which consists of 10 (ten) articles, has been approved and entered into force electronically by the Member by reading each provision.
